The Kitsap Public Utilities District (KPUD) has existing water facilities and an easement on the City's Lovgreen property. KPUD's existing waterline is in need of repair, and the associated well has not been in production for a number of years. The existing waterline runs under a small creek and through a wetland on the site.
In order to avoid disturbing these critical areas, KPUD desires to amend the existing easement and thereby extinguish a portion of that easement to relocate the waterline into a new easement that will run primarily under the gravel access road the City recently improved in order to use the site as a spoils backfill site. The proposed easement will not restrict the City's existing or planned use of the site.
Attached is the proposed Amended Waterline Easement and Agreement. For context, also attached is the easement that is being amended (1999 Easement), and two sketches that show the existing easement and the proposed easement.
