The City Council first considered this item at its meeting on November 14, 2017. The proposed trail connection agreement is being proposed to resolve a right-of-way dispute between the City and landowners ("Ohrt") related to Duane Lane in exchange for the construction of a public trail connection between Sportsman Club Road and Weaver Road.

Under the terms of the proposed agreement, the City would agree to initiate and process a street vacation related to Duane Lane. In exchange, after the public process that would occur to pursue the proposed street vacation, if the Council approves the vacation, then Ohrt would construct and pay for the proposed trail connection (approximately 449 feet) between two trails, one coming from Sportsman Club Road and the other coming from Weaver Road, and thereby create a constructed trail over 1,200 feet long between these two roads. The trail connection would include a bridge over a creek.

Under the terms of the proposed agreement, if the Council does not approve the street vacation, the agreement shall terminate and Ohrt shall have no obligation to complete the subject trail improvements.

As part of the proposed agreement, Ohrt has received consent from another property owner who has agreed to provide an easement over their property, which will allow a connection between the trails and create one continuous trail between Sportsman Club Road and Weaver Road.

The proposed agreement also addresses the processing of an associated minor plat amendment or alteration regarding the Reserve at Winslow subdivision related to the proposed trail.

The version of the proposed agreement included in the agenda packet shows in track changes the revisions that are proposed from the previous draft that was provided to the Council. The revisions are intended to address input provided by the Council when the proposal was presented to the Council at the November 14 Council meeting.
