The applicant, Blackwood Holdings IV, LLC, requests approval to subdivide a 3.42-acre parcel into 7 residential lots, where single-family homes will be constructed. The site is zoned R-2 and is located at the south end of Sunrise Drive, immediately south of 10781 Sunrise Drive NE.
On December 3, 2013, the applicant submitted a preliminary subdivision application. On July 23, 2014, the Hearing Examiner conducted an open record public hearing on the preliminary subdivision, continued the hearing on August 21, 2014, continued again on September 26, 2014, remanded to City staff for further specific studies and documentation on October 20, 2014, was reopened on September 4, 2015, and was continued until September 11, 2015.
On September 21, 2015, the Hearing Examiner issued a decision of approval with conditions on the preliminary subdivision. The Hearing Examiner’s decision was then appealed to the Superior Court of Washington for Kitsap County where the petition was denied. On November 1, 2017, the applicant submitted a final subdivision application.
In accordance with the provisions of BIMC 2.16.160 and BIMC 2.16.130, the application for final subdivision is before the City Council for a decision. This is a quasi-judicial matter and a closed record proceeding.
Pursuant to BIMC 2.16.160(H), the City Council shall approve the final long subdivision if it determines:
- That the conditions imposed through the preliminary subdivision have been met;
- Bonds or other assurance devices, if any, by their essential terms assure completion of all plat improvements; and
- The requirements of state law, the BIMC, the Comprehensive Plan, and any other applicable ordinances in effect at the time of preliminary plat approval have been satisfied by the subdivider.
Pursuant to BIMC 2.16.130.F, the City Council shall take one of the following actions:
- Adopt the resolution, including findings of fact and conclusions of law, approving the proposal; or
- Adopt a resolution, including findings of fact and conclusions of law, approving the proposal with conditions; or
- Adopt a resolution, including findings of fact and conclusions of law, denying the proposal; or
- Refer the proposal back to the Hearing Examiner for further proceedings.
