The City Council passed Ordinance Nos. 2018-02 and 2018-03 declaring a temporary six-month moratorium on the acceptance of certain development applications, with specified exclusions. On February 15, 2018, the Council enacted Ordinance No. 2018-05 (attached) amending the previous ordinances by restating those ordinances, except with regard to the effective date and duration provisions of the moratorium. Also, Ordinance No. 2018-05 did not change the basis for the declaration of emergency that was included in Ordinance No. 2018-02 and Ordinance No. 2018-03. The moratorium continues to have an effective date of January 9, 2018.
On February 27, 2018, the Council discussed making additional changes to the moratorium and passed two motions directing staff to prepare an ordinance to make the following revisions, which have been incorporated into new Ordinance No. 2018-09.
One revision would amend Section 3.C of the current moratorium to provide an exception for Major Site Plan Reviews and Major Conditional Use Permit proposals for properties located in the Mixed Use Town Center/Central Core Overlay District.
The other revision would amend Section 5.B of the current moratorium to provide an exception for all “educational facilities and preschools.”
In addition, Councilmember Peltier has prepared a memo recommending an additional amendment to the moratorium. That memo is attached.
