DESCRIPTION/BACKGROUND

On June 14, 2016, the City Council adopted the City's procurement policy to govern the City's purchasing, procurement, and public works procedures.

 

Attached for the City Council's review is a proposed update to the City's procurement policy. The proposed update includes:

 

A. Authorization for the City Manager to Execute Certain Grant Documents

 

Proposed amendments to Section 15.1 of the procurement policy would authorize the City Manager to execute all required agreements and documents with a grant-issuing agency to effectuate any grant approved or accepted by the City Council.

 

B. Authorization for the City Manager to Enter Into Certain Leases

 

Proposed changes to Section 15.3 of the procurement policy would authorize the City Manager to enter into leases of real property where the rent does not exceed $50,000 total over the term of the lease. However, the City Council's approval would be required for all leases of real property that are for a term or more than five (5) years. 

 

The $50,000 limit is consistent with the contracting authority that the City Council has previously delegated to the City Manager in other contexts. For example, the procurement policy authorizes the City Manager to award contracts for public works projects costing less than $50,000. 

 

C. State Auditor's Office Recommendations

 

Proposed additions of Sections 5.2.7 and 17, and related proposed changes to Section 5.3, would adopt recommendations made by the State Auditor's Office following the April 2017 Federal Grant Audit and ensure compliance with applicable federal law.

 

D. Changes to State Law

 

Proposed changes Section 5.7 would update the procurement policy to reflect changes in state law related to payment and performance bond requirements. Specifically, the proposed update would address changes to RCW 39.08.010(3), which was amended in 2017. 

 

E. Environmentally-Friendly Purchasing Policy

 

Proposed addition of a Section 4.7 would adopt a new environmentally-friendly purchasing policy for the City, which would require the City to purchase environmentally-friendly products whenever appropriate environmentally-friendly products are available and reasonably priced compared to competing products. 

 

F. Neonicotinoids and Pesticides 

 

Proposed addition of Sections 4.8 and 4.9 would formally include in the procurement policy purchasing restrictions on products containing neonicotinoids and certain pesticides that were previously adopted by the City Council. 

 

The proposed update would also correct several minor spelling and grammar issues throughout the procurement policy.
