DESCRIPTION/BACKGROUND

The Winslow Way Ravine Outfall Project consists of replacing approximately 100 LF of storm piping near Waypoint Park (SR305/Winslow Way) and installing energy dissipation gabion basket structures and other miscellaneous work.

Bids were solicited through the Municipal Research and Services Center ("MRSC") Roster and four bids were received. The City Council awarded the construction contract to the apparent low bidder, Harbor Point Excavating, in the amount of $159,975.00 at the April 10, 2018, Council meeting.

On June 26, 2018, staff received a letter from Harbor Point Excavating stating they are unable to perform the work due to financial difficulties. Pursuant to the contract documents and incorporated WSDOT Specifications, Section 1-03.5 Failure to Execute Contract, Harbor Point must forfeit its proposal bond in the amount of $7,998.75 and the contract may be awarded to the next lowest responsible bidder.

City staff recommends terminating the contract with Harbor Point Excavating and instead awarding the contract to the second low bidder, SeaLevel Bulkhead Builders, in the amount of $193,463.42. Additional funds in the amount of $34,000.00 are needed for contingency funds and awarding the contract. Upon City Council authorization, a budget amendment will be included in the 2nd quarter budget reporting.

 



RECOMMENDED ACTION/MOTION

I move to terminate the contract with Harbor Point Excavating for the Winslow Way Ravine Outfall Project, and to authorize the City Manager to award the contract to the second low bidder, SeaLevel Bulkhead Builders, in the amount of $193,463.42, and to authorize an associated budget amendment in the amount of $34,000.00, thereby increasing the spending authority for this project.
